Alternativní způsoby řešení sporů ve stavebnictví

Abstract

Diplomová práce se věnuje tématu Alternativních způsobů řešení sporů ve stavebnictví se zaměřením zejména na jeden z alternativních způsobů řešení sporů „Radou pro spory“ (Dispute boards), využití v České republice a v zahraničí. Hlavní předností Rady pro spory je odbornost rozhodců a předcházení sporům. Jako diplomat studijního programu Stavební inženýrství na problematiku „Alternativních způsobů řešení sporů ve stavebnictví“ pohlížím pohledem budoucího stavebního inženýra s několika měsíci praxe v nadnárodní stavební společnosti a nikoli, jak název diplomové práce může evokovat, pohledem budoucího právníka. Zmíněny jsou jednotlivé zákony ve stavebnictví, které jsou klíčovým pramenem v případě vad, poruch či sporů. S tím souvisí téma FIDIC, které nabízí nový způsob řešení sporů, a to adjudikací a Rady pro spory. Stěžejní částí práce je představení adjudikace a Rady pro spory, její historický vývoj, využití v zahraničí, procesní postupy, výhody, využití na území České republiky. V závěru práce je provedeno zhodnocení této nové metody řešení sporů a dotazník ze zahraničních zemí, které již tento nový způsob využívají.

The diploma thesis is devoted to the topic of Alternative methods of dispute resolution in the construction industry, with a particular focus on one of the alternative methods of dispute resolution, "Dispute board", used in the Czech Republic and abroad. The main strength of the Disputes Board is the expertise of the members and the avoidance of disputes. As a master’s degree student of the Civil Engineering study program, I look at the issue of "Alternative dispute resolution in the construction industry" from the point of view of a future civil engineer with a few months of experience in a multinational construction company and not, as the title of the diploma thesis might suggest, from the point of view of a future lawyer. Individual laws in the construction industry are briefly mentioned, which are a key source in case of defects, malfunctions or disputes. A related topic on FIDIC, which then turns to a new method of dispute resolution, namely adjudication and Dispute Boards. The central part of the work is the presentation of adjudication and the Disputes Council, its historical development, use abroad, procedural procedures, advantages, use in the territory of the Czech Republic. At the end of the thesis, there is an evaluation of this new method of dispute resolution and a questionnaire from foreign countries that already use this new method.
