Zakládání pracovněprávních vztahů v konkrétní organizaci

Abstract

Bakalářská práce se zabývá pracovní smlouvou v praxi, která úzce souvisí s vymezením pracovněprávních vztahů. Hlavním bodem práce je vznik pracovního poměru a jeho náležitosti. Nejdůležitější publikace, z které jsem čerpala, je platný zákoník práce, tj. zákon č. 262/2006 Sb., který upravuje právní vztahy týkající se vzniku, změny nebo zániku pracovního poměru. Od 1. 1. 2007 je účinný nový zákoník práce, který některé věci v pracovním právu změnil. Teoretická část se zabývá především pracovněprávními vztahy, pracovním poměrem, jeho vznikem, pracovní smlouvou, jejím obsahem a související problematikou. Praktická část analyzuje jednotlivé body pracovní smlouvy, používané společností Český Aeroholding, a.s. a rovněž fungování právního a personálního oddělení této společnosti.

This bachelor thesis deals with the real world application of the employment contract, which is closely connected with defining labour law relationships. The main point of the thesis is the establishment of employment and its requirements. The principal resource that I drew on is the current Labour Code, specifically Labour Code No. 262/2006 Coll. which regulates the legal relations concerning the establishment, change or termination of employment. The new Labour Code, which came into effect 1 January 2007, changed some points of the labour law. The theoretical part of the thesis introduces especially the labour law relationship, employment, its establishment, the employment contract, its contents and correlated issues. The practical part analyzes individual points of the employment contract used by the company Czech Aeroholding, a.s. as well as the procedures of their legal and human resources department.
