Cizinecké komunity v ČR a jimi generované hrozby pro vnitřní bezpečnost ČR

Abstract

Diplomová práce na téma ,,Cizinecké komunity v ČR a jimi generované hrozby pro vnitřní bezpečnost ČR" se zabývá především vietnamskou a ukrajinskou diasporou v České republice, ale i dalšími ruskojazyčnými diasporami, které se na území ČR dopouští závažné organizované trestné činnosti. Popisuje cizojazyčný organizovaný zločin v ČR, způsoby a instrumenty boje proti organizovanému zločinu na území ČR a také v mezinárodním měřítku. Jejím cílem je navrhnout efektivnější způsoby boje proti vietnamskému a ukrajinskému organizovanému zločinu v ČR a zlepšení strategie postupů bezpečnostních sborů, které se podílejí na ochraně vnitřní bezpečnosti ČR. V teoretické části tato práce popisuje organizovaný zločin jako jednu z hrozeb pro vnitřní bezpečnost ČR. Dále se věnuje vzniku vietnamské a ukrajinské diaspory v ČR a jejich vývoji a paralelnímu vývoji organizovaného zločinu v těchto diasporách. Následuje rozbor cizinecké právní normy a její vývoj do současné doby. Práce se také věnuje základním dokumentům mezinárodního boje proti organizovanému zločinu, které byly následně zapracovány do národního práva ČR. Praktická část práce se věnuje vlastnímu boji proti organizovanému zločinu, který na území ČR páchají cizojazyčné zločinné gangy. Věnuje se právním a operativním instrumentům a postupům Policie ČR a zpravodajských služeb. V této části bylo využito několik kazuistik, objasněných případů útvaru NCOZ a pro lepší pochopení byly provedeny rozhovory s občany ruskojazyčných zemí a Vietnamu, které tuto problematiku opět posunuly o kus dál. K vyhodnocení byla provedena SWOT analýza s popisem jejích jednotlivých komponentů. V závěrečné části této práce jsou uvedeny výsledky a nejdůležitější poznatky a doporučení v boji proti organizovanému zločinu, a to jak na poli trestně právních regulací, tak v operativních a preventivních postupech.

This master thesis entitled "The Foreign Communities in the Czech Republic and the Threats they generate to the Internal Security of the Czech Republic" deals predominantly with the Vietnamese and Ukrainian diasporas in the Czech Republic, but also with other Russian-speaking diasporas, which engage in serious organized crime on the territory of the Czech Republic. It describes the organized crime perpetrated by foreign nationals in the Czech Republic and the ways and means of fighting organized crime in the Czech Republic and in the international context. The aim of the thesis is to come up with more effective ways of fighting Vietnamese and Ukrainian organized crime in the Czech Republic and to improve the strategy and procedures of the security forces that are tasked with maintaining the internal security of the Czech Republic. The theoretical part of the thesis defines organized crime as one of the threats to the internal security of the Czech Republic. It further deals with the Vietnamese and Ukrainian diaspora living in the Czech Republic and in parallel analyses the development of organized crime in these communities. This is followed by an analysis of the Czech foreign national's law and its historical development. The thesis also deals with the basic legal documents and norms on international organized crime, which have been implemented into Czech national laws. The practical part of this thesis deals with the organized crime that is perpetrated on Czech territory by foreign-speaking criminal gangs. It focuses on the legal and operational instruments and procedures of the police and the intelligence services of the Czech Republic. I have used several case studies of cases investigated by the unit for countering organized crime by foreign nationals and also some interviews with nationals of Vietnam and Russian-speaking foreign nationals that help to illustrate various aspects of the subject of the thesis. A SWOT analysis has been conducted for evaluation including a description of its individual components. The conclusion of the thesis contains the major findings and recommendations of my research regarding the fight against organized crime. These findings and recommendations concern the areas of criminal-law regulation as well as operational and preventative procedures.
