Úloha Policie České republiky při odhalování a vyšetřování drogové trestné činnosti

Abstract

Předmětem diplomové práce je analýza a shrnutí metodiky vyšetřování drogové kriminality se zaměřením na primární drogovou kriminalitu. Teoretická část je věnována základním pojmům v oblasti drog a kriminality s nimi spojené. Je zde popsán pojem droga, drogová kriminalita, protidrogová prevence a také jejich dělení. Uvedené vybrané drogy, například pervitin, kokain, heroin a marihuana, jsou popsány z hlediska jejich původu a účinků. Dále popisuje organizační strukturu útvarů Policie České republiky, které se zabývají primární drogovou trestnou činností a jejich základní úkoly. Diplomová práce se dále zabývá metodikou vyšetřování drogové trestné činnosti, kde jsou uvedeny jednotlivé metody a legislativní nástroje pro odhalování a vyšetřování takové kriminality. Praktická část je zaměřena na porovnání zkušeností s vyšetřováním drogové trestné činnosti, na její vymezení a postih ve Slovenské republice a Spolkové republice Německo. Výsledky komparace jsou v části diskuze komentovány a zároveň porovnány s výsledky jiný odborných prací. S využitím SWOT analýzy jsou definovány slabé a silné stránky současného stavu vyšetřování drogové trestné činnosti v České republice, a zároveň byly identifikovány a definovány příležitosti pro možné zlepšení současného stavu. I výsledky SWOT analýzy jsou zahrnuty do závěrečné diskuzní částí této práce a jsou přehledně vyneseny do tabulky. V samotném závěru práce bylo zhodnoceno naplnění cílů. Dále zde došlo k verifikaci či falsifikaci definovaných hypotéz.

The subject of this diploma thesis is the analysis and summary of the methodology of drug criminality investigation with focus on primary drug crime. The theoretical part is devoted to basic terms in the field of drugs and drugs-related criminality. It describes the terms drug, drug criminality, drug prevention and the classification of drugs. Some drugs, for example crystal meth, cocaine, heroin and marijuana, are described in terms of their origin and effects. Further on it describes the organizational structure of the Police of the Czech Republic of the departments dealing with prime drug crime and their basic tasks. The diploma thesis also deals with the methodology of drug crime investigation and depicts various methods and legislative tools for detecting and investigating of such criminality. The practical part is focused on the comparison of experience with the investigation of drug crime, its definition and punishment in the Slovak Republic and the Federal Republic of Germany. The results of the comparison are commented in the discussion section and at the same time compared with the results of other professional works. Using the SWOT analysis, the weaknesses and strengths of the current state of drug criminality investigation in the Czech Republic are defined, and at the same time opportunities for possible improvement of the current state were identified and defined. The results of the SWOT analysis are also included in the final discussion part of this work and are clearly presented in a chart. At the very end of the work, the fulfillment of goals was assessed. Furthermore, the defined hypotheses were verified or falsified.
