Aspekty uplatňování náhrad nákladů za zásahy prováděné u dopravních nehod jednotkami požární ochrany v ČR

Abstract

Tato bakalářská práce se zabývá aspekty uplatňování náhrad nákladů za zásahy prováděné u dopravních nehod jednotkami požární ochrany v České republice. V teoretické části je stručným způsobem popsán vývoj, základní úkoly a poslání Hasičského záchranného sboru České republiky, související legislativa a způsob financování. Dále jsou zde informace o dopravních nehodách a základní pojmy důležité pro pochopení problematiky uplatňování náhrad nákladů za zásahy prováděné u dopravních nehod. V praktické části jsou pomocí metod obsahové analýzy a komparace získaných údajů porovnány legislativní rámce České a Slovenské republiky, jsou zde vysvětleny postupy a praktické zkušenosti s uplatňováním náhrad nákladů za zásah a možnosti využití těchto finančních prostředků. Součástí praktické části je i nový výpočet paušální částky ve smyslu nařízení vlády č. 263/2013 Sb. o paušální výši úhrady nákladů. Cílem bakalářské práce je návrh souboru opatření k zajištění většího objemu finančních prostředků pro Hasičský záchranný sbor České republiky a snížení administrativní náročnosti, vyplývající ze současné právní úpravy.

Ap This Bachelor's thesis studies the aspects of recovery of costs of interventions performed during traffic accidents by the fire brigades in the Czech Republic. The theoretical part briefly describes the development, major tasks and mission of the Fire Rescue Service of the Czech Republic, as well as the related legislation and the method of financing. Furthermore, it provides information on traffic accidents and explains the key concepts necessary for understanding the procedure of recovery of costs of interventions performed during traffic accidents. The practical part uses the methods of content analysis and comparison of data acquired to compare the legislation in force in the Czech Republic and in the Slovak Republic, explaining the procedures and practical experience in recovering the costs of intervention and the possibility of use of the financial means. The practical part also includes a new calculation of the lump sum within the meaning of Government Regulation No. 263/2013 Sb. on the lump sum of recovery of the costs. The thesis aims to suggest a set of measures to secure a larger amount of financial means for the Fire Rescue Service of the Czech Republic and to reduce the administrative difficulty resulting from the legislation in force.
