Vliv rekodifikace veřejného stavebního práva na činnost inženýrské firmy

Abstract

Diplomová práce se zabývá rekodifikací veřejného stavebního práva a jejím vlivem na činnost inženýrské společnosti. V teoretické části je nejprve popsán důvod rekodifikace, její cíle a její stručná historie. Následně jsou shrnuty hlavní změny, které přinesl vládou schválený věcný záměr stavebního zákona. Z těchto změn jsou vybrány ty, které mají významný vliv na činnost inženýrské společnosti. Ty jsou následně detailně popsány a porovnány se stávající legislativou. V praktické části diplomové práce je formou dotazníkového šetření provedena analýza názoru odborné veřejnosti. Ta je rozdělena do tří skupin, na pracovníky stavebních úřadů, dotčených orgánů státní správy a pracovníky inženýringu. Další kapitola diplomové práce se věnuje porovnáním stávající legislativy se zahraničím. Většina praktické části je zaměřena na samotné posouzení vlivu rekodifikace veřejného stavebního práva na činnost inženýrské společnosti. Ten je posuzován na konkrétním projektu vybrané společnosti. Postup projednání projektu byl zaznamenán pomocí harmonogramu a následně upraven dle připravované legislativy. Z porovnání obou harmonogramů bylo odvozeno, jak se změní činnost inženýrské společnosti, jaký bude mít nová legislativa dopad na výnosy a náklady společnosti a zda se bude muset inženýrská společnost vlivem nové legislativy připravit na případné personální změny.

Diploma thesis focuses on impact of recodification of building law on an engineering services company activity. The theoretical part describes the reason for the recodification, its objectives and its brief history. Subsequently, the main changes brought by the government-approved factual intention are summarized. From these changes are selected those that have a significant impact on the activities of the engineering company. These are described in detail and compared with the existing legislation. In the practical part of the thesis, the analysis of the professional public opinion is carried out in the form of a questionnaire survey. The analysis is divided into three groups, the workers of the building authorities, the concerned state administration bodies and the engineers. The next chapter is devoted to comparing existing legislation with foreign countries. Most of the practical part is focused on the assessment of the impact of recodification of public building law on the activity of an engineering company. The impact is assessed on a specific project of the selected company. A schedule was created for the progress of the project and subsequently adjusted according to the prepared legislation. The comparison of the two schedules revealed how the activity of the engineering company will change, what impact the new legislation will have on the company’s revenues and costs and whether the engineering company will have to prepare for possible personnel changes due to the new legislation.
