Postupy a metody řešení závažné kriminality - analýza metanolových podvodů

Abstract

Abstrakt Cílem diplomové práce je přinést celkový pohled na postupy a metody, které Policie České republiky využívá při řešení závažné kriminality. Hlavním obsahem práce je charakterizovat operativně pátrací činnost a prostředky, které policie při odhalování a objasňování trestné činnosti využívá a tyto činnosti analyzovat a prakticky předvést na konkrétním případu metanolových podvodů. V teoretické části popisuji základní rozdělení kriminalistických metod a následné rozdělení operativně pátracích prostředku a nových forem objasňování trestné činnosti zejména zapojení analytických metod. Ve výzkumné části jsou uvedeny cíle a hypotézy a následně objasněny metody a výzkum práce. Výzkum měl za cíl zjistit, zda se moderní policie v současné době bez nových metod a forem vyšetřování trestné činnosti neobejde. Dále je na konkrétním zvlášť závažném případu metanolových podvodů ukázáno, jakým způsobem byly operativně pátrací prostředky nasazeny a jaké nové metody a formy vyšetřování přispěly k objasnění tak závažné kauzy. V diskuzi je uvedeno porovnání praktických metod a forem na judikátech konkrétních případů s teoretickými výklady, jak jsou uvedeny v literatuře různých autorů, zákonech a nařízeních. Závěrem jsou shrnuty všechny výsledky a cíle práce.

Abstract Global overview of procedures and methods that are applied by Police of the Czech republic in order to provide solution to serious criminality is the aim of the dissertation. Main content of the dissertation focuses to characterization of operational search activity and means assigned by police during disclosure and clarification of criminal offences, and additionally it analyses these activities and present them in particular case of methanol deceits. Basic division of criminalistic methods and subsequent allocation of operational search means and new clarification forms of crimes namely analytic methods integration are described in the theoretical part. Objectives, hypotheses and following illustrated methods as well as investigation are stated in the research part of the dissertation. The research was aimed to find out whether modern police might not dispense with new methods and clarification forms of crimes at present. Furthermore, it is presented here in particular especially severe crime of methanol deceits how operational search means were applied and how new methods and investigation forms contributed to the clarification of such a severe case. In the debate, there is a comparison of practical methods and forms assigned in particular cases of judicial proceedings with theoretical explanation stated as mentioned in literature by different authors, in various laws and regulations. All results and dissertation aims are resumed in the dissertation conclusion.
