Analýza možných opatření pro omezení dopadu teroristických útoků

Abstract

Zvyšující se frekvence teroristických útoků spáchaných na území států Evropské unie mě přivedla k myšlence zpracovat práci, ve které se budu zabývat tím, jaká opatření lze přijmout jako preventivní proti těmto útokům a tím i omezení dopadů těchto útoků. V boji proti terorismu považuji prevenci za nejdůležitější bod, proto jsem se při zpracování mojí diplomové práce zaměřil na analýzu protiteroristických, politických i právních, nástrojů Evropské unie i České republiky. Pomocí deskriptivní a kompilativní metody tato práce na začátku popisuje vybrané nástroje EU a ČR, a jejich hlavní koncepční přístupy k současnému boji proti terorismu. Následuje stanovení cíle práce a hypotéz, popis metodiky, jakým způsobem jsou v této diplomové práci analyzována vybraná preventivní opatření proti terorismu. Výsledky, dosažené pomocí SWOT analýzy u vybraných opatření, jsou obsahem praktické části této práce. Analýza byla zaměřena na preventivní opatření proti terorismu využitelné kriminální službou Policie ČR. Ta nalezneme hlavně v zákoně číslo 273/2008 Sb. o Policii České republiky. Prameny mé práce tvořily především legislativní normy Evropské unie a České republiky a monografie renomovaných autorů v oblasti terorismu. V diskuzi a závěru práce je hodnocena praktická využitelnost vybraných opatření, návrhy jejich případných úprav a doporučení pro přijetí nových opatření. Rovněž jsou zde popsány způsoby, jak lze daná opatření využívat v policejní praxi v rámci boje proti terorismu a tím i dopad využití těchto opatření na běžnou veřejnost, spolu s uvedením míry zásahu do lidských práv a svobod.

The increasing frequency of terrorist attacks perpetrated on the territory of the European Union has led me to work on a paper in which I will deal with what measures can be taken as a preventive measure against these attacks, and thus limiting the impact of these attacks. I consider prevention as the main point on the combating terrorism. Therefore, in course of my diploma dissertation's elaboration I focused on analysis of counterterrorism, political and legal instruments of European Union and even of the Czech Republic. By means of descriptive and compilation method, my diploma dissertation starts with description of selected EU and Czech Republic instruments and their main conceptual approaches to current combating terrorism. The goalsetting and hypotheses setting follows, together with description of methodology how the selected counter-terrorism measures are analysed in this diploma dissertation. The main part of my diploma dissertation contains the outcomes, achieved by SWOT analysis. The analysis focused mainly on the preventive measures against terrorism, which can be used by the Criminal Police Service of the Czech Police. These measures are mainly found in the Act on the Police of the Czech Republic No. 273/2008 Coll. The sources of my work were primarily legislative norms of the European Union and the Czech Republic and monographs of renowned authors in the field of terrorism. Within the discussion and conclusion part, I evaluate practical efficiency of selected measures, proposals of their eventual modifications and recommendation for new measures to be taken. There are also described the ways, how the said measures can be implemented to the police counter terrorism practices, together with description of the measures' impacts to the general public and its rights and freedoms.
