Možnosti a postupy Policie České republiky při řešení trestné činnosti v souvislosti s migrační krizí

Abstract

Diplomová práce na téma ?Možnosti a postupy Policie České republiky při řešení trestné činnosti v souvislosti s migrační krizí?, se zabývá problematikou protiprávního jednání migrujících osob, které vstupují a pobývají na území České republiky, kdy cílem je po seznámení se s problematikou migrace a historickým exkurzem k jejím příčinám spojeným se současnou problematikou islámu, popsat současný stav přístupu k potírání protiprávního jednání páchaného migranty a najít funkční východiska. Teoretická část je zaměřena na objasnění konkrétních pojmů, které jsou nezbytné pro zpracování této práce, zhodnocení současného stavu při kterém se zaměřuji na trestnou činnost páchanou migranty v souvislosti se vstupem na území ČR, jejich pobytem a nelegálními aktivitami, až po sofistikovanou trestnou činnost, a způsobem, jakým je tato problematika v současné době Policií České republiky postihována nejen z pohledu trestního práva, ale i práva přestupkového, což je nezbytné pro výsledek této práce. V následné praktické části, jsou vyhodnoceny prostřednictvím SWOT analýzy nedostatky, které jsem při řešení této problematiky shledal jako zásadní k jejich řešení, a které byly pro přehlednost rozděleny do problematik personální a technické, a problematiky legislativní. Na základě výsledků plynoucích ze SWOT analýzy, byly vyvozeny závěry pro zlepšení praxe, které by měly v případě vyhlášení krizového stavu ?Migrační vlna velkého rozsahu?, usnadnit policejním složkám jejich represivní řešení a postih. Výsledkem práce, který je vyjádřen v diskuzi, je pak zdůvodněné doporučení pro policejní praxi, směřující k posílení a zvýšení efektivity činnosti Policie České republiky ve vztahu k stávající a očekávané migrační vlně.

Diploma thesis on the topic of ?Options, and procedures of the Police of the Czech Republic to address crime in connection with migration crisis?, deals with the infringement of migrants entering and residing on the territory of the Czech Republic, after consulting with the migration and historical excursion to its causes associated with the current issue of Islam, to describe the current state of access to combat infringement against migrants and to find the way out. The theoretical part is designed to clarify the specific terms that are necessary for the processing of the current situation, in which I'm focusing on migrants crime perpetrated in connection with the entry into force of the Czech Republic, and illegal activities, to sophisticated criminal activities and the way in which it is currently of the Police of the Czech Republic punished under criminal law, but also those of magistrates, which is necessary for this work. In the practical with the current approach, expressed in theoretical, are evaluated through a SWOT analysis, which I found in this issue as fundamental to, and for the sake of clarity, divided into staff and technical issues, and legislative. On the basis of the results of the SWOT analysis, the conclusions for improving practice, which should, in the event of a crisis "Migration a large scale? to facilitate their repressive police forces and penalties. The work that is expressed in the discussion is then justified recommendations for police work, to strengthen and increase the efficiency of activities of the Police of the Czech Republic in relation to existing and expected migration wave.
