Divácké násilí jako bezpečnostní riziko

Abstract

Cílem této diplomové práce je popis problematiky diváckého násilí v České republice, především na fotbalových stadionech, vymezení pojmu, prohloubení vědomostí, provedení analýzy právních norem a významných událostí spojených s tímto fenoménem. Na základě zjištěných poznatků, komparací a provedením SWOT analýzy jsou autorem navržena možná opatření, která by vedla k efektivnějšímu postupu vůči problematice. Cíle práce jsou tedy deskriptivního i technického charakteru. Teoretická část definuje základní pojmy významné ke studiu, zabývá se příčinami vzniku, historií, vývojem a současným stavem diváckého násilí. Dále jsou zde analyzovány jednotlivé skutkové podstaty trestných činů a přestupků, které jsou nejčastěji páchány fotbalovými fanoušky. Na závěr této části je vyslovena hypotéza výzkumu práce. Vlastní výzkum autor uskutečňuje za využití primárních (přímá pozorování, rozhovory s fanoušky, policejní praxe) a sekundárních (odborná literatura, ostatní publikace, zákony, jiné právní předpisy, filmografie) zdrojů dat. Z těchto dat jsou definovány vnitřní (silné a slabé stránky) a vnější (příležitosti a hrozby) faktory, které jsou následně analyzovány metodou SWOT. Výsledná matice této analýzy pak definuje čtyři možné strategie dalšího postupu. V diskusi autor shrnuje výsledky výzkumu, zabývá se predikcí možného vývoje v rámci jednotlivých forem diváckého násilí. Dále jsou zde navržena možná řešení problematiky v budoucnu tak, aby došlo ke zlepšení praktických postupů všech zainteresovaných subjektů. Mezi tato opatření je řazeno zlepšení činnosti pořadatelských služeb, zkvalitnění infrastruktury a bezpečnostních prvků stadionů, efektivnější využívání dostupných právních nástrojů, přijetí speciálního zákona o diváckém násilí a zkvalitnění činnosti policie, probační a mediační služby, státních zastupitelství a soudů. Obsahem diskuse je také konstatování, že hypotéza stanovená před výzkumem, byla potvrzena.

The purpose of this thesis is a description of the spectator violence issue in the Czech Republic, primarily at football stadiums, definitions, deepening knowledge, perform the analysis of legal rules and significant events of this phenomenon. Based on the findings, comparing and performing SWOT analysis, possible measures are proposed by the author, which would lead to more effective process on the issue. The purposes are therefore descriptive and technical. The theoretical part defines meaningful terms relevant to study, deals with the causes of the origin, history, evolution and current state of spectator violence. Further, individual facts of the crimes and offenses that are most often committed by football supporters are analysed. The research hypothesis is pronounced at the end of this part. The author realize the research using primary (direct observations, interviews with supporters, police practice) and secondary (professional literature, other publications, laws, other legislation, filmography) data sources. The internal (strengths and weaknesses) and external (opportunities and threats) factors are defined from these data and then analysed by SWOT. Resulting this analysis matrix then defines four possible strategies of the next process. The author summarizes the research results and deals with the prediction of possible development of individual spectators violence forms in the discussion. The discussion includes proposed possible solutions of problems in the future as well, in order to improve the practices of all interested subjects. Improving organizing services, better infrastructure and security features of stadiums, more efficient use of available juristic instruments, adoption of a special law on spectator violence and improvement activity of police, probation and mediation service, public prosecutors and courts are sorted in these measures. Statement of confirmed hypothesis, that was determined before the research, is in the discussion too.
