Problematika veřejných zakázek ve zdravotnictví

Abstract

Téma této diplomové práce se zaměřuje na systém veřejných zakázek, který slouží pro efektivní nákup a výběr dodavatelů a jejich zboží. Rozbor zákonů, popis struktury a postupu zadávání veřejných zakázek jsou součástí aktuálního stavu problematiky. Hlavní cíl a výzkumná část práce spočívá v analýze devíti proběhlých výběrových řízení, která jsou rozdělena do kategorií podle předpokládané hodnoty na zakázky malého rozsahu, podlimitní a nadlimitní zakázky. Ke každému typu zakázek jsou přiřazeny tři zakázky ze třech typů různých nemocnic - fakultní, krajské a městské. Z provedených analýz vyplývá porovnání rozdílů mezi zakázkami, možné nedostatky a chyby, pozitiva a negativa. Pro provedení analýzy byla stanovena vlastní metodika postupů pro porovnávání realizovaných veřejných zakázek, která vyplývá z jejich struktury. Diskuze shrnuje nejen výsledky z provedených analýz, ale komplexně zhodnocuje celou problematiku a dopady veřejných zakázek. Diskuze je zaměřena na jednotlivé části veřejných zakázek, jejich přizpůsobování a elektronické nástroje. Výsledkem práce je stanovení možných návrhů opatření k možnému řešení celé problematiky a vylepšení současného stavu.

The topic of the thesis is focused on the public procurement system, which is used for effective purchase and selection of suppliers and their products. The current state of the problem is aimed on law analysis, the structure of public tenders and procurement process. The main target and research part is devoted to the analysis of 9 reciprocal tenders in the past. The division of tenders is on small-scale contracts, below-threshold and above-threshold contracts. For each type of contracts are assigned 3 orders from 3 different types of hospitals - teaching hospital, regional hospital and city hospital. The analysis shows the differences between tenders, and highlights their positive and negative qualities. To perform the analysis, it has been necessary to establish new methodological procedures, which arises from the structure of public contracts. The discussion summarizes all of the results of the analysis and comprehensively evaluates the whole issue and impacts of public procurement. The discussion focuses on specific parts of procurement, contracts adaptation and tender digital instruments. The result of this work is the determination of proposals for possible solutions to the public tenders issues and improve the current situation.
