Úloha Policie ČR při řešení krizových situací v důsledku teroristického útoku

Abstract

Diplomová práce se v úvodní části zabývá legislativním ukotvením postavení Policie České republiky v rámci právního systému našeho státu jako základního pilíře vnitřní bezpečnosti. Popisuje její základní úkoly a její organizační strukturu, která napomáhá k plnění zákonem daných povinností. Dále se snaží popsat a postihnout problematiku terorismu jako takového, definovat jeho jednotlivé formy a typy teroristické činnosti v celosvětovém kontextu včetně historického exkurzu do problematiky. Reflektuje motivy, které vedou teroristy k páchání zavrženíhodných zločinů na nevinných lidech a rozsévání strachu. Dále se tato diplomová práce zabývá popisem teroristické skupiny či organizace z hlediska její vnitřní hierarchie a rozdělení úkolů uvnitř takového uskupení. V druhé části této práce jsou popsány specializované protiteroristické útvary Policie České republiky včetně jejich vnitřní struktury a speciálních úkolů, které zabezpečují připravenost Policie České republiky v boji proti terorismu. Zásadní část pak tvoří analýza legislativní rámce trestního práva a připravenost tohoto systému k vyhledávání, objasňování a vyšetřování trestné činnosti v souvislosti s terorismem na území České republiky, jako jednoho z hlavních úkolů Policie České republiky v souvislosti se zajišťováním vnitřní bezpečnosti státu. Analyzuje v současnosti platnou legislativu v porovnání s předešlým zněním Trestního zákoníku a změnami, kterým zákon v důsledku implementace mezinárodních právních norem prošel. K vyhodnocení byla použita prostá analýza získaných informací, získaných na základě literární rešerše a osobních a odborných zkušeností a také SWOT analýza, která odhaluje slabé a silné stránky současného nastavení systému, pomáhá identifikovat ohrožení, která systému mohou hrozit, ale v neposlední řadě nabízí možná řešení k posílení systému a nastavení strategií rozvoje systému tak, aby byl co nejlépe schopen reagovat na dynamiku vývoje dané problematiky.

This thesis deals with the legislative embedding of the position of the Police of the Czech Republic within the legal system of our state as the basic pillar of internal security. It describes it´s basic tasks and it´s organizational structure which helps to fulfill the statutory duties. It also tries to describe the issue of terrorism, to define it´s individual forms and types of terrorist activities in a global context, including a historical excursion into the issue. It reflects some motives that lead terrorists to commit reprehensible crimes on innocent people and to spread fear. Moreover this thesis deals with description of a terrorist group or organization in terms of it´s internal hierarchy and the division of tasks within this group. In the second part of this thesis there are described specialized anti-terrorist units of the Police of the Czech Republic including their internal structure and special tasks which ensure the preparedness of the Czech Police in the fight against terrorism. In the main part of the thesis there is an analysis of the legislative framework of criminal law and the preparedness of this system to search, elucidate and investigate terrorism related crime in the territory of the Czech Republic as one of the main tasks of the Police of the Czech Republic in connection with ensuring the internal security. It analyses the current legislation in comparison with the previous version of the Criminal Code and changes that the law passed through the implementation of international legal norms. To evaluate there was used a simple analysis of the information gained on the basis of literary research, personal and professional experience, as well as a SWOT analysis that reveal weaknesses and strengths of the current system setup, also it helps to identify threats that may threaten the system but it also offers solutions to strengthen the system and set up system of the development strategies to be able to respond to the dynamics of the development of the issue.
