Analýza trestné činnosti dětí ve Středočeském kraji v letech 2022-2024

Abstract

Základním zaměřením této práce je analýza nejčastěji páchaných činů jinak trestných a provinění dětskými a mladistvými pachateli v oblasti Zákona č. 40/2009 Sb., Trestního zákoníku. V teoretické části se práce nejdříve věnuje vymezení základních pojmů, které se potřebné pro orientaci v řešené problematice. Následně je rozebrán Zákon č. 218/2003 Sb., o odpovědnosti mládeže za protiprávní činy a o soudnictví ve věcech mládeže a o změně některých zákonů. Ze zákona byly vybrány části týkající se zásad, trestního řízení a opatření. Dále se teoretická část věnuje popisu jednotlivých prostředí, které působí na rizikovost jedince. Poslední a zároveň nejrozsáhlejší část byla věnována přehledu nejčastěji páchaných trestných činů. Metodikou zpracování této práce byla zvolena analýza statistických dat. Využitá data poskytovali informace o spáchané trestné činnosti nezletilých a mladistvých pro celou Českou republiku a pro Středočeský kraj v letech 2022-2024. Tato analýza byla podpořena jednak dotazníkovým šetřením mezi policisty pracujícími na Oddělení obecné kriminality, jednak dotazníkovým šetřením mezi dětmi na druhém stupni základní školy. Pro úplnost a pravost informací uvedených v práci byl zařazen strukturovaný rozhovor s policisty z Oddělení obecné kriminality, kteří se přímo specializují na problematiku nezletilých a mladistvých pachatelů. Získané výsledky korelovali s výsledky statistických dat. Podrobněji se tím práce zabývá v jednotlivých dílčích cílech i v diskusi a závěru práce. Součástí výsledků práce je navržení doporučení v rámci edukace dětí v oblasti trestního práva.

The basic focus of this work is the analysis of the most frequently committed otherwise criminal acts and offenses by child and juvenile offenders in Act No. 40/2009 Coll., the Criminal Code. In the theoretical part, the work first focuses on defining the basic concepts that are necessary for orientation in the issue being addressed. Subsequently, Act No. 218/2003 Coll., on the responsibility of youth for illegal acts and on justice in youth matters and on amendments to certain laws, is analyzed. Parts of the law relating to principles, criminal proceedings and measures were selected. Furthermore, the theoretical part is devoted to the description of individual environments that affect the riskiness of an individual. The last and most extensive part was devoted to an overview of the most frequently committed crimes. The methodology chosen for processing this work was the analysis of statistical data. The data used provided information on the criminal activities committed by minors and young people for the entire Czech Republic and for the Central Bohemian Region in the years 2022-2024. This analysis was supported by a questionnaire survey of police officers working in the General Crime Department, and a questionnaire survey among children in the second level of primary school. For the completeness and authenticity of the information provided in the work, a structured interview with police officers from the General Crime Department, who directly specialize in the issue of minors and young people, was included. The obtained results correlated with the results of statistical data. The work deals with this in more detail in the individual partial objectives and in the discussion and conclusion of the work. Part of the results of the work is the proposal of recommendations within the framework of the education of children in the field of criminal law.
