Právní aspekty degradace vybraných městských veřejných prostranství

Abstract

Degradace veřejných prostranství, proces snižování a znehodnocování jejich žádoucích kvalit, má mnoho různých forem. Jednou z nich je přemíra dopravně-technické vybavenosti, například dopravního značení, stožárů, technických skříní a venkovní reklamy. Významnou úlohu přitom sehrávají právní a technické předpisy, jejich znalost a interpretace ze strany jednotlivých aktérů v rámci procesu tvorby a správy veřejných prostranství. Cílem práce je zjistit, do jaké míry jsou vybrané formy degradace zapříčiněny zněním těchto předpisů a jaké jsou možnosti jejich úpravy. Cílem je také zjistit míru závažnosti zkoumaných forem degradace ve vybraných českých i zahraničních městech a jak kvalitu a degradaci veřejných prostranství vnímá veřejnost. V závislosti na charakteru výzkumného problému je zvolena forma bádání teoreticko-empirické povahy kvantitativně-kvalitativního charakteru. V úvodní části práce je nastíněn historický vývoj vybavenosti veřejných prostranství, kvality a formy degradace veřejných prostranství. V teoretické části práce je využita metoda obsahové analýzy pro posouzení relevantních právních a technických předpisů. V praktické části jsou využity metody terénního výzkumu, dotazníkového šetření a moderovaného rozhovoru. Celkový závěr výzkumu je přijat na podkladu dílčích závěrů teoretické a praktické části práce. Lze konstatovat, že základním nedostatkem stávající legislativy je nejasné zakotvení pojmu veřejné prostranství, složitý systém veřejné správy a nastavení kompetencí jednotlivých aktérů. Výzkum navíc ukazuje zajímavé výsledky z hlediska četnosti dopravně-technické vybavenosti v českých a zahraničních městech, stejně jako míry vnímání dané problematiky ze strany veřejnosti. Tato práce může sloužit jako teoretická základna pro navazující akademické práce, zabývající se degradací veřejných prostranství. Zároveň obsahuje doporučené postupy pro praktické využití v oblasti tvorby a správy veřejných prostranství, stejně jako konkrétní náměty na úpravu stávající legislativy ve prospěch zvýšení kvality veřejných prostranství.

Degradation of public spaces, the process of reducing and devaluing their desired qualities, can take many different forms. One of them is the over-abundance of technical equipment, e.g. traffic signs, poles, technical cabinets and outdoor advertising. Legal and technical regulations, their knowledge and interpretation by individual parties play an important role in the process of creating, managing and maintaining public spaces. The aim of this thesis is to determine to what extent the selected form of degradation is caused by the wording of these regulations and to what are the possibilities of their change. It is equally important to find out the degree of severity of the studied form of degradation in selected Czech and foreign cities and how the degradation of public spaces is perceived by the public. A form of research balancing theoretical and empirical approach using quantitative, as well qualitative research is chosen to best answer the research question. The introductory part of the thesis outlines the historical development of the equipment of public spaces, the qualities of public spaces and also forms of their degradation. The theoretical part of the thesis uses the method of content analysis to assess the relevant legal and technical regulations. The analytical part of the thesis uses the method of field research and the method of a questionnaire survey and moderated interviews. The overall conclusion is drawn on the basis of partial conclusions of the theoretical and analytical part of the thesis. The research has shown that the basic shortcoming of the current legislation is the unclear definition of the concept of public space resulting in unclear setting of competencies of individual parties. The research has shown interesting results in terms of the frequency of technical equipment in Czech and foreign cities, as well as the degree of public perception of the issue at hand. This thesis can serve as a theoretical basis for subsequent academic work, dealing with the degradation of public spaces. At the same time, it contains a number of recommended procedures for practical use in the field of design and management of public spaces, as well as specific suggestions for possible changes in legal and technical regulations in favour of improving the quality of public spaces.
