Možnosti zneužití nebezpečných chemických látek a jejich směsí

Abstract

Nebezpečné chemické látky a směsi, dále jen NCHL, jsou neodmyslitelnou součástí našeho světa. Jednotlivé nebezpečné vlastnosti jako toxicita, žíravost, výbušnost, hořlavost, dráždivost a další, nalézají nejen své využití, ale také zneužití ve vztahu k terorismu, nebo jiným nelegálním násilným aktivitám, které vedou k ohrožení civilního obyvatelstva nebo slouží k dosažení určitých cílů. Předmětem této bakalářské práce je zjistit, do jaké míry mohou být dnešní průmyslové chemické látky, které jsou dostupné na trhu, hrozbou pro širokou veřejnost ve vztahu ke zneužití v podmínkách České republiky. V teoretické části se bakalářská práce zabývá obecným přehledem českých a evropských právních předpisů vztahujících se k dostupnosti a možnostech manipulace s těmito látkami. Uvede nás od základních právních předpisů jako evropská nařízení CLP a REACH, skrze právní předpisy přímo se týkající nakládání s NCHL obecně až do jednotlivých oblastí drog, pesticidů, výbušnin, střelivin, laboratorních chemikálií a dalších látek a směsí. Tato práce se tedy nezabývá pouze jedovatými chemickými látkami, ale všemi nebezpečnými vlastnostmi vymezenými mezinárodním systémem GHS. V praktické části je zpracována SWOT analýza těchto předpisů v oblasti dostupnosti NCHL široké veřejnosti. Z výsledků je patrné, že tato oblast je komplexně pojata a má veliký potenciál v rámci budoucího vývoje legislativy. Ze slabých stránek vyplývá, že jsou určité oblasti, o které je třeba se zajímat a do budoucna s nimi pracovat. Zejména oblast plynů pod tlakem, ale také výbušnin a jejich prekurzorů, které vždy byly a budou aktuální hrozbou pro společnost. Dostupných NCHL, které by se daly zneužít, je veliké množství. I když se nejedná o zbraně hromadného ničení, s dobře promyšleným plánem se dají napáchat značné škody. Tato práce přináší obecný náhled do této problematiky a ukazuje jednotlivé směry, kam se dále ve výzkumu ubírat.

Dangerous chemical substances and their mixtures are an essential part of our world. Single hazardous properties such as toxicity, corrosivity, explosiveness, flammability, irritability, and other properties have not only their utilization, but they can also be abused for terrorist attacks and other criminal violent activities, that can endanger civilians. The topic of this bachelor thesis is to find out how the contemporary industrial dangerous chemical substances available on the market can be threatening to general public in the relation of the abuse in Czech Republic territory. Theoretical part of the thesis is dedicated to the Czech and European Union law related to the availability and possibility of manipulation of these substances in general. From the basic law regulation, like CLP Regulation and REACH Regulation, through the law regulations related to the handling of dangerous chemical substances, to the specific areas like drugs, pesticides, explosives, laboratory chemicals and other chemical substances and mixtures. This work focuses not only on poisonous chemical substances, but all the hazardous properties defines with Globally Harmonized System of Classification and Labelling of Chemicals. Practical part contains SWOT analysis of this law regulation of availability of this dangerous chemicals for the general public. The outcomes of the analysis show us how complex the chemical legislation is, and also that it has very high potential for the future lawmaking progress. The weaknesses discover the specific fields, that need close attention and need to be improved. The field of gases under pressure as well as explosives and their precursors in particular, which have always been and will be the threat to the society. There is a multitude of available dangerous chemical substances that can be abused. Although these are not the weapons of mass destruction, these chemical and elaborate plan is enough to make a significant damage. This bachelor thesis provides the general overview of the matters and offers the particular ways for the following research.
