Analýza systému povolovacího procesu staveb a návrh jeho inovace

Abstract

isertační práce řeší několik problémů. Prvním z nich je aplikace systémového přístupu v povolovacím procesu staveb, návrh jeho optimalizace-inovace a management rizik u povolovacího procesu staveb. Platný stavební zákon je velmi nepřehledný. Bez znalostí jeho praktických aplikací a vnesení systémových prvků nelze povolovací proces staveb optimalizovat. Systémový přístup umožňuje za určitých podmínek optimalizovat celý proces povolování staveb, díky čemuž lze ušetřit značné finanční prostředky investora. V mnoha případech může jít o úspory řádově v desítkách milionů. Vlastní identifikace systému "povolovací proces staveb" ukazuje na složitost a variabilnost povolovacího procesu. Bez perfektní identifikace a kvalitního managementu této fáze lze sice dosáhnout vytčeného cíle, ale nelze zajistit optimalizaci celého procesu. K návrhu systému "povolovacího procesu staveb" je nezbytná výborná znalost stavebního práva a principů systémového inženýrství. Pro optimalizaci stavebních projektů je velmi důležité řízení rizik. V první fázi je nutné znát teoretická východiska pro management rizik. Tento obecný princip managementu rizik je upraven pro využití ve stavebních projektech. Jsou popsány základní principy managementu rizik, bez něhož nelze úspěšně realizovat složitější projekty ve stavebnictví. Tyto obecné principy jsou podkladem pro aplikaci managementu rizik u konkrétních stavebních projektů.Dalším řešeným problémem je ověření, zda nedochází k nezákonným vstupům komunálních politiků do činnosti stavebních úřadů. Občas totiž představitelé radnic zasahují do výhradních pravomocí stavebních úřadů. Obvykle jsou takové intervence neškodné a nemají nezákonný charakter. Nicméně v některých případech mohou být tlaky představitelů radnic na stavební úřady velice silné. Tyto zásahy nezvýhodňují jen představitele obcí, ale i třetí osoby. Doktorand provedl dotazníkové šetření mezi stavebními úřady, které potvrdilo zásahy politiků do činnosti stavebních úřadů. Jedním ze způsobů, jak snížit tyto zásahy, je personální oddělení pracovníků stavebních úřadů od obcí.

The dissertation solves several problems. The first one is the application of the system approach in permitting constructions process, the proposal of its optimization and innovation and the risk management in a process of building permits. The current Building Act is very unclear. Without knowledge of its practical applications and bringing in system elements, the permission process cannot be optimized. The system approach enables - under specific conditions - to optimize the whole permitting constructions process, thanks to which it is possible to save sizeable funds of investors. In many cases, the savings may be in order of tens of millions. The identification of this system "process of building permits" itself shows its complexity and variability. Although it is possible to achieve the objective in this phase without the top management and the perfect identification, the optimization of the whole process cannot be ensured. For the proposal of the permission process system, excellent knowledge of the construction law and system engineering principles is necessary. The risk management is very important for the optimization construction projects. In the first phase it is necessary to know the theoretical basis for the risk management. The general principle of the risk management is adapted for use in construction projects. There are described basic principles of the risk management. Difficult projects in the construction industry cannot be successfully implemented without the risk management. These general principles are the basis for the risk management applications for specific construction projects.The next issue has to verify if there are any illegal entries of municipal politicians to the activities of building authorities. Sometimes the town hall representatives intervene into the exclusive competence of building offices. Usually, these interventions are harmless and do not have an illegal character. Nevertheless, in some cases it might be a very hard interference by municipal representatives with the work of the building office. These interferences are not only a matter of the personal benefit of the municipal leaders but they are also about gaining the advantage over other subjects. The PhD student conducted a questionnaire survey among the building offices which confirmed politicians' interventions in the work of building authorities. One way how to reduce these interventions is the separation of the personnel and labour relations among employees performing state administration and the municipalities.
