Kosmické právo a možnosti jeho začlenění do českého právního řádu

Abstract

Z důvodu zvyšujícího se zájmu soukromých subjektů v České republice o působení v kosmickém prostoru a ambic České republiky v oblasti kosmického průmyslu se v posledních letech stalo předmětem zájmu vytvoření české kosmické legislativy, především kvůli zajištění regulace kosmických aktivit a dostání závazkům plynoucích z mezinárodních kosmických smluv Organizace spojených národů (OSN), jejichž je Česká republika smluvní stranou. Teoretická část práce se věnuje výkladu mezinárodního kosmického práva, s důrazem na pět hlavních smluv. Praktická část navazuje analýzou již existujících kosmických legislativ vybraných států. Následně je přistoupeno ke komparaci těchto úprav v oblasti udržitelnosti kosmického prostoru, která stále více vzbuzuje pozornost světových kosmických autorit díky rostoucímu kosmického provozu. Poslední částí práce obsahuje analýzu současného stavu České republiky, vyhodnocení potřeby přijetí národní kosmické legislativy současně s návrhem jejího možného znění a předpokládané časování jejího přijetí.

Due to the increasing interest in engagement in space activities of private entities in the Czech Republic and the Czech ambitions in the field of space industry, the establishment of Czech national space law has become a matter of concern mainly to ensure a smooth space regulation and to implement the obligations arising from the United Nations international space treaties to which Czech Republic is a contracting party. The theoretical part of this thesis delves into the interpretation of the international space law, focusing on the five main treaties. The practical part builds upon this by analyzing existing legal frameworks for space activities in selected countries. Subsequently, the author conducted a comparative study of these regulations in the context of outer space sustainability, which has garnered significant attention from global space authorities due to the exponential growth in space operations in recent years. The final segment of the thesis comprises an assessment of the ongoing progress in the development of space legislation in the Czech Republic, evaluating the necessity of its adoption, along with exploring the possible avenues for its formulation and the expected timeline for its establishment.
