Alternativní tresty v resocializační praxi

Abstract

Práce se zabývá vteoretické části analýzou využívání alternativních trestů vresocializační praxi se zaměřením na druh trestuzákazu vstupu na sportovní, kulturní a jiné společenské akce. Právědůsledný postih za páchání tohoto specifického druhu kriminality, jako je výtržnictví a násilnosti páchané na sportovních stadionechje otázkou posledních let, kdy tragické události při fotbalových utkáních odstartovaly diskusi o nutnosti přijetí bezpečnostních opatření na stadionech. Práce se vpraktické části věnuje komparaci řešení tohoto závažného problému vČeské republice a vzemích EU se zaměřením na prevenci týkající se fotbalového násilí. Práce se ztotožňuje snastoupenou cestou řešení tohoto celospolečenskéhoproblému, na kterém se podílejí, a to především při fotbalových utkáních, bezpečnostní složky tzn. P olicie ČR včetně složek Integrovaného záchranného systému. Vyváženost preventivních opa tření a vpřípadě nutnosti nezbytnost použití represivního prvku je základem řešení tohoto závažného negativního jevu. Nicméně působení na lidský faktor zůstává alfou a omegou jeho úspěšnosti, ať vpozitivním či negativním smyslu.The theoretical part of the work deals with the analyses of utilization of alternative punishments in resocialization practice with the focus on such type of punishment when one is forbidden to enter any sports, cultural or other social events. The consistency of the sentencing for commitment of this specific type of a crime such as disorderly conduct and violent acts committed in sports arenas is a matter of recent years when tragic events on football matches provoked discussion on the necessity to accept safety precautions on the stadiums. The practical part of the paper is devoted to the comparison of solutions to this serious problem in the Czech Republic and EU countries with the focus on prevention related to the football violence. The work agrees with the commenced way of solving this social problem, with the participation, mainly on football matches, of the security forces ?Police of the Czech Republic including Integrated Rescue System. The balance of preventive precau tions and when necessary, the necessity to imply punitive acts, is the basis for solutions of this serious negative phenomenon. Nevertheless, its impact on the human factor remains the alpha and omega of its success, in both positive and negative meaning.
