Zpravodajské služby na území České republiky: formy činnosti při získávání informací

Abstract

Diplomová práce je zaměřena na téma rozšiřování oprávnění zpravodajských služeb, konkrétně na možnosti rozšíření oprávnění při získávání informací o policejním oprávnění (předprocesním). V práci se vychází z předpokladu, že takové rozšíření oprávnění by zvýšilo efektivitu výkonu zpravodajských služeb. V práci se dále vychází z předpokladu, že zásadní překážkou pro rozšiřování oprávnění zpravodajských služeb je rigidní lpění na dodržování oddělovacího imperativu (oddělení zpravodajských služeb od služeb policejních). Proto je práce zaměřena na argumentaci proti implementaci oddělovacího imperativu při reálné výstavbě bezpečnostní struktury České republiky. V práci je používán jako hlavní termín tajné služby. Pod tento termín jsou zařazeny nejen zákonně definované zpravodajské služby České republiky, ale také specializované policejní útvary, například Národní protidrogová centrála SKPV. Práce se skládá ze dvou částí, a to teoretické a praktické. V teoretické části jsou objasněny základní pojmy související s danou problematikou. Jedná se o pojmy zpravodajství, operativní, tajná nebo zpravodajská služba. V praktické části je poté provedena analýza zpravodajských oprávnění a jsou také zpracovány dvě instrumentální případové studie. První instrumentální případová studie se zabývá roky 1918 - 1938 a druhá případová studie se zabývá roky 1968 - 1989. Na základě komparace a analýzy oprávnění současných tajných služeb České republiky a na základě dvou instrumentálních případových studií jsou formulovány argumenty proti nutnosti dodržovat oddělovací imperativ při reálné konstrukci bezpečnostní struktury České republiky. Vzhledem k současné bezpečnostní situaci by rovněž došlo k odstranění zásadní překážky bránící rozšíření oprávnění zpravodajských služeb na území České republiky.

The diploma thesis is focused on the extension of the authorization of intelligence services, specifically the possibilities of extending the authorization in obtaining information about police authorization (pre-trial). The thesis builds on the assumption that such an extension would increase the efficiency of the performance of intelligence services. The work is also based on the assumption that the major obstacle to the extension of intelligence services competencies is rigid compliance with the separation imperative (separation of intelligence services from police services). Therefore, the thesis focuses on the argumentation against the implementation of the separation imperative in the real construction of the security structure of the Czech Republic. The main term of the thesis is "secret services". This term includes not only legally defined intelligence services of the Czech Republic, but also specialized police units, such as the National Anti-Drug Center of the Criminal Police and Investigation Service. The thesis consists of two parts - a theoretical part and a practical part. The theoretical part explains basic terms related to the given issue, namely the terms "intelligence service" and "operative", "secret" or "intelligence service". The practical part includes the analysis of intelligence authorizations as well as two instrumental case studies. The first instrumental case study focuses on the time period from 1918 to 1938 and the other case study deals with the time period from 1968 to 1989. Based on the comparison and the analysis of the authorizations of current intelligence services of the Czech Republic as well as on the two instrumental case studies, arguments against the necessity to maintain the separatist imperative in the real process of construction of the security structure of the Czech Republic are formulated. With respect to the current security situation, this would also eliminate the major obstacle impeding the extension of the authorization of the intelligence services of the Czech Republic.
