Majetkoprávní vypořádání veřejně-prospěšných staveb

Abstract

Cílem diplomové práce je přiblížit problematiku dopravní infrastruktury se zaměřením na majetkoprávní vypořádání pro veřejně prospěšné stavby, které jsou určitým způsobem specifické a v některých případech vyžadují složitější řešení. V teoretické části je popsáno financování dopravní infrastruktury, základní pojmy a definování týkající se veřejných staveb a legislativa zabývající se dopravní infrastrukturou – zákon o územním plánovaní a stavebním řádu (stavební zákon) a zákon o urychlení výstavby dopravní, vodní a energetické infrastruktury a infrastruktury elektronických komunikací (liniový zákon). Praktická část popisuje jednotlivé postupy majetkového vypořádání zaměřené zejména na postupy v stavebním řízení a také popisuje nejčastěji se vyskytující problémy spojené s vypořádáváním práv nemovitostí a návrh jejich řešení.

The main objective of this thesis is to approach the problem of transport infrastructure by focusing on property settlement of publicly beneficial constructions that are specific in certain ways and in some cases require more complex solutions. The theoretical part of this thesis describes the financing of transport infrastructure, basic concepts and definitions relating to public construction, and legislation concerning transport infrastructure – The Construction Act and the Spatial Planning Act (Building Act) and Act on Accelerating the Construction of Transport, Water, Energy and Electronic Communications Infrastructure (Line Act). The practical section outlines specific property settlement procedures with a focus on particular aspects of construction management processes. Moreover, it depicts the most common problems related to Real Estate Right Settlement and the proposal of their solutions.
