Abstract

Diplomová práce na téma ?Oprávnění a povinnosti příslušníků Policie České republiky? popisuje a analyzuje povinnosti a oprávnění policistů, která jsou stanovena v zákoně o Policii České republiky. Práce zároveň poukazuje na současný stav právních norem a snaží se přinést ucelený náhled na oprávnění a povinnosti příslušníků Policie České republiky a zmapování povědomí o této části práv. Vymezuje teoretické (právní), ale i praktické problémy těchto skutečností. Praktická část obsahuje komparaci oprávnění příslušníků policie České republiky s příslušníky policie jiných států. Porovnává vybraná oprávnění a situace. Cílem této práce je analýza vybraných oprávnění, která zasahují do základních lidských práv a svobod garantovaných Listinou základních práv a svobod a Ústavou České republiky. Dále komparuje vybraná oprávnění s některými zahraničními policejními sbory. Výsledky srovnání a analýzy zjišťují, zda oprávnění a povinnosti příslušníků Policie České republiky jsou dostačující. Případně kde by mohlo dojít k dalším legislativním úpravám a zlepšením.

The diploma thesis on the topic of ?Competencies and obligations of the Police of the Czech Republic? describes and analyses the obligations and competencies of police officers that are specified in the Act on the Police of the Czech Republic. The thesis also highlights the current state of legal regulations and attempts to provide a comprehensive view on the competencies and obligations of the Police of the Czech Republic, while mapping the awareness of this part of the obligations. It defines the theoretical (legal), but also the practical problems of these realities. The practical part contains the comparison of the competencies of the Police of the Czech Republic with the competencies of police officers from other states. It compares the chosen competencies and situations. The aim of this thesis is the analysis of the selected obligations that interfere with the fundamental human rights and freedoms guaranteed by the Charter of Fundamental Rights and Freedoms and the Constitution of the Czech Republic. Further, it compares the selected competencies with those of certain foreign police forces. The results of the comparison and analysis try to determine, whether the competencies and obligations of the Police of the Czech Republic are sufficient. Alternatively, where further legislative changes and improvements could be made.
