Trestně právní aspekty teroristických trestných činů na území České republiky

Abstract

Tématem práce jsou Trestně právní aspekty teroristických trestných činů na území České republiky. V teoretické části je shrnuta historie, vývoj a trendy boje proti terorismu. Rovněž jsou zde i informace o protiteroristické politice České republiky včetně trestněprávní úpravy platné v České republice a okolních státech (Německá spolková republika, Polská republika (dále jen Polsko), Slovenská republika (dále jen Slovensko), Rakouská republika (dále jen Rakousko)). V praktické části jsou vyhodnocená data poskytnutá jednotlivými Krajskými ředitelstvími Policie České republiky. Na základě uvedených zdrojových dat jsou zodpovězeny otázky týkající se věkového složení pachatelů jednotlivých teroristických činů a jejich motivace. Tato diplomová práce dále obsahuje stručnou komparaci trestně právní legislativy platné v České republice, Slovensku, Polsku, Německé spolkové republice a Rakousku. Celé je to doplněno analýzou 3 až 5 případů s extremistickým kontextem, spáchaných na území České republiky včetně zhodnocení trestněprávní kvalifikace z hlediska aplikační praxe.The topic of the thesis is Criminal aspects of terrorist crimes in the Czech Republic. The theoretical part summarizes the history, development and trends in the fight against terrorism. There is also information on the Czech Republic's counter-terrorism policy, including the criminal law in force in the Czech Republic and neighboring countries (Federal Republic of Germany, Poland, Slovakia, Austria). The practical part evaluates the data provided by individual Regional Directorates of the Police of the Czech Republic. Based on the above source data, questions concerning the age composition of perpetrators of individual terrorist acts and their motivation are answered. This diploma thesis also contains a brief comparison of criminal law legislation in force in the Czech Republic, the Slovak Republic, Poland, the Federal Republic of Germany and Austria. The whole is supplemented by an analysis of 3 to 5 cases with an extremist context, committed in the Czech Republic, including the evaluation of criminal law qualifications in terms of application practice.
