Administrace změn závazků výstavbového projektu dle zákona, standardizovaných smluvních podmínek a interních směrnic veřejných zadavatelů

Abstract

S rostoucí složitostí projektů dopravní a inženýrské infrastruktury se zvyšuje i potřeba flexibilního, avšak transparentního a právně ukotveného systému řízení změn. Diplomová práce se zaměřuje na problematiku administrace změn závazků výstavbových projektů v kontextu zákona č. 134/2016 Sb., o zadávání veřejných zakázek, smluvních vzorů vydávanými Mezinárodní federací konzultačních inženýrů a Českou agenturou pro standardizaci a vybraných směrnic veřejných zadavatelů upravující administraci změn. Práce analyzuje teoretický a právní rámec změn na úrovni Evropské unie, České republiky a krajů České republiky, jejich klasifikaci a problematiku finančních limitů. Zjištěné poznatky dále využívá v příkladové administraci změn na modelové stavbě, přičemž zvláštní pozornost věnuje právě směrnicím Ředitelství silnic a dálnic s. p., Správě a údržbě silnic Pardubického kraje a Krajské správě a údržbě silnic Středočeského kraje, p.o. Na základě provedených analýz a případových studií přináší návrhy na zefektivnění administrativních procesů, především v tvorbě dokumentace evidující změny závazků.With the increasing complexity of transportation and engineering infrastructure projects, the need for a flexible yet transparent and legally grounded change management system is also growing. The thesis focuses on the issue of administering changes to construction project commitments in the context of Act No. 134/2016 Coll., on Public Procurement, contract templates issued by the International Federation of Consulting Engineers and the Czech Agency for Standardization and selected public contracting authority guidelines regulating change administration. The thesis analyzes the theoretical and legal framework for changes at the level of the European Union, the Czech Republic, and the regions of the Czech Republic, their classification, and the issue of financial limits. The findings are further applied in an example of change administration on a model construction project, with special attention given to the guidelines of the Directorate of Roads and Motorways, the Administration and Maintenance of Roads of the Pardubice Region, and the Regional Administration and Maintenance of Roads of the Central Bohemian Region. Based on the conducted analyses and case studies, the thesis offers proposals for streamlining administrative processes, especially in the preparation of documentation recording commitment changes.
